Drug Related License Suspensions

If your Massachusetts License has been suspended for a drug offense, you may be able to appeal your license suspension and obtain a hardship license from the Registry of Motor Vehicles or the Board of Appeal. A suspended license lawyer can help you.

You are eligible to apply for a hardship license from the RMV after you have served 1/2 of the term of your license suspension. Under certain circumstances, you may be able to get a hardship license sooner from the Board of Appeal.

You must have proof of completion of the proper drug treatment program as well as documentation of three (3) clean urine screens. The clean urine screenings must be from the 3 months preceding the hardship license hearing.

You must also supply a letter from probation which is not more than 30 days old, stating that you are in compliance with probation.

You must also prove that you have a legitimate hardship. The Registry will require you to provide a letter from you employer, on letterhead, which cannot be more than 30 days old. The letter must state your need for a hardship license and the work hours. A suspended license attorney can help you with the content for your work letter.

If you are self employed, you must present proof of self-employment. Acceptable forms of proof consist of a business certificate, tax forms indicating self-employment, and/or a current professional license. If you are self-employed, you must also present a letter on your own behalf explaining your need for a hardship license and the hours requested. If your are applying for a hardship license for other purpose (i.e. education, medical treatments), the RMV will require third party documentation of the hardship.

Finally, you must provide proof regarding the unavailability of public transportation. In certain circumstances, if you receive a hardship license, you will be required to install and use an ignition interlock device (IID) on each vehicle which you own, lease, or operate. Also, if you have a Commercial Drivers License, convictions of certain drug offenses might cause your CDL to be suspended.

Although you might meet all requirements, issuance of a hardship license is only granted at the reasonable discretion of the RMV or the Board of Appeal, based on the facts of the case. This is why it is important to be represented by an attorney. There is absolutely no guarantee that you will receive a hardship license. 1 Year Drug Related License Suspensions

A first conviction of illegal possession of a Class A, B, C, or D Drug will result in a one year license suspension, with hardship license consideration after 6 months. Conspiracy to Violate the Massachusetts Drug Laws also results in a 1 year loss of license.

2 Year Drug Related License Suspensions

A conviction of possession with intent to distribute a Class D controlled substance (Marijuana) or a class E drug triggers a 2 year license revocation, with hardship license consideration after 1 year.  Uttering a false or forged prescription also results in a 2 year license suspension.

3 Year Drug Related License Suspensions

The Mass. RMV will suspend your license for three (3) years for a conviction of possession with intent to distribute a class a, b, or c controlled substance.  Hardship consideration is available after serving 1.5 years of the drug suspension. 

4 Year Drug Related License Suspensions

The Registry of Motor Vehicles will revoke your driver’s license for a period of four (4) years for a second or subsequent conviction of Possession with Intent to Distribute a Class A, B, or C, controlled substance or a second or subsequent conviction of illegal possession of cocaine. Hardship License consideration is available after serving 2 years of the 4 year revocation. 

5 Year Drug Related License Suspensions

The Mass. RMV will impose 5 year license revocations for drug trafficking or drug distribution convictions.  Hardship consideration is possible after serving 2.5 years of the 5 year revocation period. .

When hearing a hardship license appeal for a drug related suspension, the Board of Appeal is always concerned with the likelihood of recidivism, especially where the Appellant’s record contains numerous drug charges. If you are seeking a hardship license because of a drug related license suspension, you must be prepared to show that any drug addiction is being successfully managed and controlled.

You can show that you are in con trol of any substance abuse addition by submitting proof of completion of a drug treatment program as well as counseling and aftercare. Attendance at AA, NA, Alanon and other similar group therapy meetings is also evidence of someone who is addressing his or her dependency.

Proof of compliance with probation is another key to success. Someone who is not in good standing with his or her probation officer is generally not a good risk for issuance of a hardship license. On the other hand, someone who appears before the Board with the support of his or her probation officer, in the form of a letter, has a better chance of success.

Another way to increase your chances of getting a hardship license is to own up to and take responsibility for your record. The time to try the case was before you plead out or got convicted. The Board of Appeal is no place to try your drug case. Instead, you should be prepared to admit to what you did and show that you have accepted responsibility. Someone who denies blame and will not take responsibility for his or her actions is generally not a good candidate for a hardship license.
