The Mass. RMV uses facial recognition technology and other means to detect drivers who have obtained or tried to obtain false licenses. Pursuant to G.L. c. 90 § 24B, it is a felony with a maximum sentence of 5 years in state prison to make false statements on a Massachusetts Driver’s License Application. Providing a false name, date of birth, or social security number constitutes the crime of driver’s license fraud. Also, under the Mass. false driver’s license law, it is a felony to impersonate someone or use another person’s information when applying for a Mass. driver’s license.
A person convicted of violating G.L. c. 90 § 24B will have his driver’s licenses suspended for 1 year. Also, a false license conviction counts as a predicate offense for 4 year Habitual Traffic Offender revocations.
In addition to the law on false driver’s licenses, someone who uses another person’s information to obtain a driver’s license may be guilty of identity fraud. Providing false information to obtain any identification card or other evidence of such another’s identity violates the Massachusetts identify theft law, a misdemeanor which carries a fine up to $5,000 and/or imprisonment for up to 2 ½ years.
